Embassy Developments Limited (formerly Equinox India Developments Limited and earlier Indiabulls Real Estate Limited), a company incorporated under the Companies Act, 1956, having its registered office at Office No 01-1001, WeWork, Blue One Square, Udyog Vihar Phase 4 Rd, Gurugram, Haryana – 122016 and corporate identity number L45101HR2006PLC095409 (“Company”, “we”, “us”, “our”), values your trust and respects your right to privacy. Pursuant to the successful implementation of the scheme of amalgamation of NAM Estates Private Limited (an Embassy Group entity) with the Company, effective January 24, 2025, vide order dated January 7, 2025 of the Hon’ble National Company Law Appellate Tribunal, New Delhi Bench (NCLAT), the Company continues to be committed to safeguarding your personal information. 

This Privacy Policy explains how your data is collected, used, stored, and disclosed by us. If you do not agree with the terms herein, please do not use or access our websites or applications. 

General 

This Privacy Policy applies to our website and applications (mobile or hybrid). It applies regardless of whether you access our services via computer, mobile phone, tablet, television, or any other device. It also applies to users who register on our website/applications in connection with our services, or whose data we otherwise receive in connection with our services. By using our platforms, your personal data will be processed in accordance with this Policy. 

Personal Data and Its Collection 

Personal Data” means any information relating to an identified or identifiable natural person (you/the “data subject”), including but not limited to: name, address, email ID, telephone number, bank/account details (including credit/debit instrument details), device details, and any other information you voluntarily provide (including to UIDAI/CIBIL/any CIC or similar agencies), as permitted by applicable law. 

Information Collected When You Use Our Website 

We collect information to provide and improve our services: 

  • Account/Registration: When you register or sign up, we may collect identifiers such as your name, email address, contact number, PAN, passport number, etc. 
  • Contact/Feedback/Testimonials: If you contact us or submit feedback/testimonials, we may collect your name, email ID, and contact number. 
  • Usage & Log Data: We collect data about how you use our services, including log and location information. 
  • Campaigns & Public Sources: We may receive information about you through campaigns and publicly available sources. 
  • Communications: If you communicate with us—or via our platform—we may collect the content and metadata of such communications. 
  • Social Sign-In: If you choose to sign in or connect via a social media account, you consent to our collection and use (per this Policy) of the data you make available via that interface (please review your social provider’s privacy policy for details). 

Information Collected When You Use Our Applications 

When you download or use our mobile/hybrid applications, we may collect (without limitation): email ID, name, address, country/city, and mobile number. 

We generally collect Personal Data only when you provide it voluntarily. Upon such disclosure, we may verify/collate information from publicly and commercially available sources (as permitted by law) and combine it with data we receive from you or from third-party social networks (if you connect such services). 

Lawful Basis of Processing 

We may process your Personal Data because: 

  • we have a contract with you; 
  • you have given us consent; 
  • we are providing services you purchased or opted for; 
  • we are complying with legal obligations. 

Use of Personal Data 

We use Personal Data to:

Information Sharing and Disclosure 

Access to your Personal Data is restricted to personnel who reasonably need it to operate, develop, or improve our services. 

We do not rent or sell your Personal Data. We may share it:
  a) to provide products/services you’ve requested;
  b) with your consent;
  c) under the following circumstances: 

  • Service Providers/Partners: With trusted vendors working under confidentiality obligations to support IT, hosting, communications, marketing, analytics, customer support, and related functions. They must use the data solely to perform services for the Company. 
  • Group Companies: With Embassy Group entities/affiliates for legitimate business and (where applicable) marketing purposes (subject to your consent where required). 
  • Legal/Regulatory: To comply with applicable law, respond to lawful requests, establish/exercise legal rights, or defend against legal claims. 
  • Safety/Fraud: Where necessary to investigate/prevent illegal activities, suspected fraud, or threats to safety, or for enforcement of our terms. 
  • Business Transactions: In connection with mergers, acquisitions, restructuring, or transfer of business/assets (including the amalgamation referenced above). You will be notified where required by law if a different policy applies post-transfer.   

Consent to International Transfer of Data 

Your data may be processed outside India in line with this Policy and applicable law. Where EU/UK or other jurisdictional rules apply, we will implement appropriate safeguards (e.g., contractual clauses) for international transfers. 

Third-Party Links and Content on Services 

Our services may link to third-party websites/applications beyond our control. We are not responsible for their privacy practices. Please review their policies before providing any Personal Data. The Company and the Embassy Group shall not be liable for any loss/damage arising from your use of third-party sites or content.  

Minors 

You must be at least 16 years old to use the Site/Application (or older if required by local law).

Outside the EU/UK, if you are under 18 or the age of majority in your jurisdiction, you must use the services under the supervision of a parent/legal guardian/responsible adult. 

Data Retention 

We retain Personal Data no longer than necessary for the purposes described in this Policy or as required by legal, regulatory, contractual, or statutory obligations. After retention periods expire, Personal Data will be deleted or archived per applicable laws and limitation periods. 

Control Over Your Information 

Subject to applicable law (including GDPR where applicable), you may have rights to access, correct, update, erase, restrict, object, or port your Personal Data.

In your request, please specify the Personal Data to be changed/erased or the limitations you seek. We aim to respond within 30 days for most requests; complex matters may take longer, in which case we will inform you of next steps. 

Security and Confidentiality 

We implement reasonable technical and organizational measures (managerial, operational, physical, and technical) to protect your Personal Data against unauthorized access, loss, misuse, alteration, or disclosure. While we strive to protect your information, no method of transmission or storage is 100% secure. You are responsible for maintaining the confidentiality of your account credentials.

Social Media 

We operate official pages/accounts on certain social platforms to inform and engage with users. We may monitor/record public comments about the Company to improve our services.

Please do not share sensitive Personal Data (e.g., health, biometric, racial/ethnic origin, political opinions, religious beliefs, sexual orientation, criminal records, national IDs) or offensive/illegal content via social channels. We are responsible only for content posted by us on our official handles. 

Consent 

We may seek your consent (opt-in) for specific processing (e.g., certain marketing, third-party sharing, cookies, or cross-border transfers where required). Marketing Preferences / Opt-Out

Disclaimer 

The Company is not liable for any loss/damage resulting from disclosures due to factors beyond our reasonable control, or from third-party errors/omissions/inaccuracies. The Company does not store credit/debit card details. Any personal/sensitive data provided to us that we did not request during registration (mandatory/optional) is considered voluntarily furnished; we are not responsible for any breach related to such unsolicited information. 

No Contractual Rights 

This Privacy Policy does not create contractual or other legal rights on behalf of any party, unless otherwise expressly stated. 

Intellectual Property Rights 

The Company retains all intellectual property rights (including copyrights, trademarks, and patents) in all content available on or via our website/applications (including text, graphics, and logos).
